- "Seller," refers to a User who submits a YouTube channel for sale on ChannelKart.

- "Listing," refers to the information provided by a Seller about a YouTube channel available for sale on ChannelKart.

- "Platform" refers to ChannelKart as a marketplace for buying and selling YouTube channels.

- "Content" refers to the various videos, posts, playlists, descriptions, titles, thumbnails, and other media elements that are uploaded and presented on that specific YouTube channel. It encompasses any visual or audiovisual material that creators produce and share with their audience on their YouTube channel.

“Transition Period” refers to the duration of at least 7 days during which the channel undergoes the transfer process from the seller to the buyer.

Platform Description

ChannelKart is a dedicated online platform operated and owned by Channelkart Social Services, providing a marketplace for the purchase and sale of YouTube channels. Our platform serves as a conduit for users interested in acquiring or divesting ownership of YouTube channels.

- Respectful Conduct: Users are expected to conduct themselves in a respectful and professional manner when interacting with support personnel on the platform, refraining from engaging in any abusive, harassing, or discriminatory behavior, else it may result in termination of our services to the offending user.

- Due Diligence: Buyers are responsible for thoroughly evaluating listed YouTube channels and conducting their own due diligence before making a purchasing decision. This includes, assessing channel authenticity, content quality, and considering any potential risks associated with the acquisition.

- Transparency: Sellers are required to provide transparent and accurate information about their YouTube channels, including relevant metrics and any known issues or concerns from past and present.

- Communication: Users are encouraged to communicate openly and honestly with our support team regarding any inquiries, issues, or disputes that may arise during the buying or selling process.

Platform Policies

- Content Guidelines: Channels with content that violates our platform's policies, including but not limited to content that promotes violence, hate speech, illegal activities, or any other inappropriate content, may be rejected or removed from ChannelKart. These guidelines are designed to maintain the integrity and reputation of ChannelKart as a trusted marketplace for buying and selling YouTube channels.

- Fair Use of Platform: Users are expected to use ChannelKart in a fair and responsible manner, respecting the rights and interests of other users and the integrity of the platform. Any misuse or abuse of ChannelKart may result in termination of our services to the offending user.

- Feedback and Reviews: ChannelKart encourages users to provide honest and constructive feedback on their experiences with transactions and interactions on the platform. However, users are prohibited from submitting fake or misleading reviews, and any attempts to manipulate the feedback system will be subject to disciplinary action.

Termination

ChannelKart reserves the right to terminate or suspend access to our services for any user who violates our terms and conditions or engages in misconduct on the platform. Grounds for termination may include, but are not limited to, the following:

- Breach of Terms: Users found to be in violation of our terms and conditions, including prohibited activities or content guidelines, may face suspension of access to ChannelKart services.

- Misuse or Abuse: Any misuse or abuse of ChannelKart, including fraudulent activities, spamming, harassment, or any other conduct that disrupts the integrity of the platform, may result in suspension of access.

- Non-Compliance with Laws: Users who fail to comply with applicable laws, regulations, or legal requirements while using ChannelKart may have their access to our services suspended.

Upon suspension, users will no longer have access to our services on ChannelKart.

Selling Process and Guidelines For Sellers

- Channel Listing: Upon submitting a channel sell request on www.channelkart.com, you'll be directed to our seller support via WhatsApp chat, where we discuss crucial aspects, including price negotiation. Once all details are agreed upon, to list a YouTube channel for sale on ChannelKart, sellers must provide manager access to ChannelKart for channel verification and necessary screenshot capture. Sellers are required to promptly inform ChannelKart if their channel is sold elsewhere, receives strikes, if the seller changes their decision and decides not to sell it anymore, or experiences significant events like termination, demonetization, or any restriction affecting its listing status and price during the 30-day lock-in period which starts from the day seller agreed to sell his channel. Failure to provide timely updates may result in the seller being liable for payment of listing charges amounting to INR 499. Sellers can continue operating their channels until a buyer is found. Additionally, sellers must disclose the channel's past history, regardless of whether explicitly requested. Only monetized or not monetized yet channels can be sold; demonetized channels are ineligible.

- Transition Period & Payment: Upon finding a buyer, ChannelKart will request the seller to provide owner access of the channel to ChannelKart. Channel access for the buyer will be facilitated by ChannelKart. Sellers are required to wait for a minimum of 7 days after providing access to the buyer to receive payment, as this is the minimum duration needed for the channel transfer to be completed. Payment is disbursed to the seller only after the successful completion of the channel transfer. Sellers are strictly prohibited from posting, making any changes to channel, or revoking access to Channelkart or the buyer of the channel once access has been shared with the buyer. In case of non-compliance with these guidelines, the deal may be canceled, and the seller may be held liable to pay 10% of the agreed price with the seller. If any issues arise with the channel during the transition period due to pre-existing content or any past issues, the deal will be nullified, and the channel will remain with the seller.

- Ownership Agreement: After successfully providing channel ownership to the buyer, sellers must provide an agreement in the format provided by ChannelKart. All costs related to the agreement will be borne by the seller. ChannelKart reserves the right to withhold payment until the agreement is provided. 

- Important Guidelines For Seller:

- Sellers are prohibited from attempting to sell another creator's channel under any circumstances.

- ChannelKart reserves the right to sell or not to sell a channel without providing a reason.

- No advance payment will be issued to the seller under any circumstances.

- ChannelKart may charge sellers an advance listing fee of INR 499 per listing, if deemed necessary.

- ChannelKart does not guarantee the sale of a channel; if buyers find the channel unsuitable, it may remain unsold.

- Sellers cannot compel ChannelKart to buy a channel.

- Payment will be made via the payment method provided by ChannelKart.

- Sold channel can't be got back.

Buying Process and Guidelines For Buyers

To provide you a safe and secure Channel is our utmost priority.

- Channel Selection & Payment: Once you've found a channel you like on www.channelkart.com and agreed on the price with our buyer support, we'll check if the channel is still available. If it is, you can go ahead and pay. If you need more information about the channel before paying, just ask our support team. After you've paid, you'll get access to the channel within 24 hours, and we'll let you know as soon as its access is granted. If we are not able to provide channel access within 24 hours and you can’t wait any longer, you have the option to request a refund or choose another channel. But remember, refunds will only give you back the money you paid.

- Transition Period and Channel Transfer: Once you get access to the channel, you need to wait for at least 7 days before you can start posting content or changing anything in the channel. If you don't follow this rule and something goes wrong with the channel because of it, the deal will be considered successful, and you won't be eligible for any refunds or compensation. Once the transfer is completed, you can start posting content and making changes as you want. No refunds will be provided once channel access is granted, except for issues not previously discussed or mentioned on the website.

- Important Guidelines For Buyers: Once the transfer is successfully completed, the buyer assumes full responsibility for the channel, all the content available on the channel, as well as any issues like termination, suspension, or restrictions, whether they happen because of past, present, or future events. In such cases, the buyer bears full responsibility, and Channelkart will not be liable to provide any refund or replacement channel. Channelkart can’t be held liable for any of these issues. Therefore, it's crucial to thoroughly inspect the channel before purchase and adhere to YouTube's guidelines to prevent any problems.

Dispute Resolution

In the event of a dispute between users or between a user and ChannelKart, we encourage parties to attempt to resolve the issue amicably and informally. If a resolution cannot be reached through direct communication, the following dispute resolution process will apply:

- Negotiation: The parties involved in the dispute are encouraged to engage in good-faith negotiations to resolve the issue. This may involve discussing concerns, clarifying misunderstandings, and seeking mutually acceptable solutions.

- Mediation: If negotiations are unsuccessful, parties may opt for mediation facilitated by ChannelKart or a third-party mediator. Mediation provides a structured environment for parties to discuss their differences with the assistance of a neutral mediator, with the goal of reaching a mutually acceptable resolution.

- Arbitration: If mediation does not result in a resolution, parties may choose to pursue arbitration as a final means of dispute resolution. Arbitration involves presenting the dispute to an impartial arbitrator or panel, who will render a binding decision based on the evidence presented by both parties.

It is important to note that participation in dispute resolution processes, including mediation and arbitration, is voluntary and non-binding unless otherwise agreed upon by all parties involved. ChannelKart will endeavor to facilitate the resolution of disputes in a fair, timely, and impartial manner.

Miscellaneous

- Amendments: ChannelKart reserves the right to modify, amend, or update these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our platform. It is your responsibility to review these terms periodically for updates. Continued use of ChannelKart after the posting of changes constitutes acceptance of the modified terms.

- Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of India.

- Severability: If any provision of these terms and conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions.

- Entire Agreement: These terms and conditions constitute the entire agreement between you and ChannelKart regarding your use of our platform, superseding any prior agreements or understandings between you and us.

- Termination: ChannelKart reserves the unilateral right to terminate its services without prior notice to any party.

To the fullest extent permitted by applicable law, we disclaim all representations, warranties, and conditions regarding our website and its use. However, this disclaimer does not:

- Limit or exclude our or your liability for death or personal injury.
